Media liability insurance FAQ

Ten genuine questions with answers drawn from providers' own materials and established insurance references. Every answer below is sourced; the full source list sits at the bottom of the page.

What is media liability insurance?

It is a specialized form of errors and omissions insurance for the legal risks of creating and distributing media content. Hiscox titles its product “Media Liability Insurance Coverage,” and Chubb describes its MediaGuard as a broad, flexible errors and omissions insurance solution for traditional and non-traditional media organizations. Philadelphia Insurance Companies says its policy addresses liability arising from media activities, including the creation and distribution of media content resulting from a media wrongful act.

What kinds of claims does it address?

Across the providers in this directory, the recurring categories are defamation (described as libel and slander), copyright and trademark infringement, invasion of privacy, misappropriation, and negligence connected to media activities. Markel's May 2026 product announcement lists lawsuits alleging reputational damage, invasion of privacy, misappropriation, copyright and trademark infringement, and negligence; Chubb's materials add intellectual-property infringement, privacy violations, and breach of confidentiality.

Is media liability insurance the same as E&O insurance?

Media liability insurance is best understood as a specialized form of E&O for media activities. Chubb presents MediaGuard as an errors and omissions insurance solution, and Markel describes its media products as layerable with miscellaneous E&O coverage parts, which shows how the market treats media liability as sitting inside the broader E&O family rather than as something entirely separate.

What is the difference between claims-made and occurrence coverage?

IRMI defines a claims-made policy as coverage triggered when a claim is made against the insured during the policy period, regardless of when the wrongful act took place, subject to any retroactive date. Chubb describes the occurrence form of its MediaGuard as covering activities that occur during the policy period, regardless of when the claim is first made. PHLY offers its media liability endorsements on either basis. Which form a product uses is set in the policy itself.

Does the policy pay for my legal defense?

That depends on the policy. IRMI defines duty to defend as an insurer's obligation to provide an insured with a defense to claims made under a liability policy, generally broader than the duty to indemnify. Chubb's MediaGuard materials describe a choice between reimbursement of defense costs or duty to defend, which means the defense arrangement varies by product. Confirm how defense is handled in the actual policy wording.

I only publish on social media. Do insurers actually write this coverage for creators?

Insurers describe offerings aimed directly at creators. Beazley says its media liability offering addresses social influencers and content creators; Kinsale lists bloggers, vloggers, influencers, and content creators among its target classes; and Markel describes its Media Shield and Entertainment Shield as designed for qualified content creators. These are descriptions of whom providers market to, not advice about whether coverage fits your situation.

Can media liability be combined with cyber coverage?

Often, yes, as a package. USLI's miscellaneous professional application lists Media Liability as a selectable coverage part alongside network security and privacy liability and data breach expense coverage. Markel describes its media products as layerable with miscellaneous E&O, general liability, technology, or cyber coverage parts. The exact combination available depends on the provider and the policy.

How is media liability insurance sold?

Through licensed insurance agents and brokers. Hiscox presents its media liability offering through its broker channel, and providers including USLI, AXIS, Beazley, and PHLY publish applications used in the underwriting process. This directory does not sell insurance or take applications; it links to providers' own materials for further reading.

Will a policy cover claims from things I published before the policy started?

It depends on the policy form and dates. Under an occurrence form like the one Chubb describes for MediaGuard, activities during the policy period are covered regardless of when the claim is made. Under a claims-made form, IRMI notes that a retroactive date can exclude wrongful acts that took place before that date. The answer for any real policy is in its declarations and wording, not in a general summary.

Is this directory recommending any of these providers?

No. Every provider profile is informational only, built from the provider's own public materials, and is not a recommendation or endorsement. The directory gives no insurance advice, offers no quotes, and takes no applications. For guidance about a specific situation, consult a licensed insurance professional or attorney.

How answers were written: each answer restates what cited providers or references say. Where products differ, the answer says so instead of generalizing. Nothing here is insurance advice.

Informational only. This directory is an educational resource. It is not insurance advice, not a recommendation of any provider or product, and not an offer to sell insurance. Coverage descriptions summarize providers’ own public materials; actual coverage depends on the terms, conditions, limits, retentions, and exclusions of the policy as issued.
